Montpelier Barred From Condemning Pavilion Hotel

Montpelier was enjoined from condemning the 92 year old Pavilion Hotel which the state bought in 1966 for 146000. A Superior Court judge granted the permanent injunction halting state or city actions to seal or condemn the structure. The order followed a brief hearing in Washington County Chancery Court. The city had demanded boarding up entries within 15 days to avert condemnation. The attorney general argued the fire code applies only to municipal buildings. The city is drafting a letter to require sealing under the city building code.

Oakes Plans Appeal to Lift Malloy Injunction

Atty. Gen. James Oakes says he prepared an appeal to the U S Circuit Court of Appeals to lift a permanent injunction against Motor Vehicle Commissioner James Malloy. Judge Bernard Leddy’s order bars Malloy from interfering with the sale or distribution of two 1969 Dodge cars with super lights, after a temporary order followed his refusal to permit inspection for highway use. Malloy argues federal safety acts do not override state safety laws as the case proceeds.
