Corcoran’s suit over water ties to zoning change debate

Zoning trustees face two issues in Corcoran case. He claims unlawful denial of water and sewer connections and seeks to reinstate a May injunction lifted in October that blocked the village from enacting its zoning ordinance affecting his trailer park. The village argues Corcoran cannot stop passage. injunction should come after enactment. Superior Court lifted the injunction and dismissed the complaint, allowing a new suit after the ordinance is passed. The meeting rezoned several properties on South Street from R-3 to commercial. Benedict, Saunders, Moore and Themelis, plus Plumb’s rear lot, were affected. Community members argued zoning determines land value and can curb use. officials defended it as a fair method to balance residential and commercial needs and to guide growth along Elm and Union streets. Non-conforming uses existing at enactment are not affected. The case raises injunction timing and the broader zoning philosophy.
