Fayette was found guilty by a U S District Court jury of influence peddling in Rutland The eight women and four men deliberated four hours before the verdict and the case was continued 10 days for sentencing Fayette faces up to one year in prison a 1000 dollar fine or both The government said he accepted 3000 in 1963 to influence Washington officials for a postmastership for Ned Handy in St Johnsbury Fayette and former Caledonia Sheriff Fred Flint were charged with the deal and Handy later claimed denial of the postmaster job due to his refusal to contribute 3000 as patronage The defense maintains Fayette returned the money after learning its purpose The trial included testimony from Gov Hoff U S Sen George D Aiken Atty Gen-elect James L Oakes and Judge Donald OBrien as character witnesses The principal government witness was FBI agent John Fawkes who cited an alleged confession from Fayette in December 1963
