Vermont Supreme Court Denies Russell Habeas Corpus
The Vermont Supreme Court upheld a Windsor State Prison arrest ruling, denying Henry Roy Russell a writ of habeas corpus. Russell, a fugitive from North Carolina, was arrested January 17 on an executive warrant from Gov. Hoff at the request of Gov. Moore. He had escaped a 1967 North Carolina prison term for assault with a deadly weapon. Justice Milford Smith ruled the Vermont court cannot judge North Carolina procedures, noting such a move is outside Vermont's powers.
