Minnesota High Court Rules In State Tax Exemption Case
The Minnesota Supreme Court overruled the Tax Department in two cases, upholding that out of state shipments are exempt from sales and use taxes when the ultimate destination is outside Minnesota. De Luxe Check Printers, Inc. and Seller Manufacturing Co., Inc. win tax relief, with exemptions tied to interstate commerce. The ruling clarifies that taxes do not apply to material used at plants outside the state if not returned to Minnesota. The decision stresses the meaning of ultimate destination and supports existing Tax Court rulings.
