Supreme Court narrows civil rights removal to limited cases
The Supreme Court ruled that civil rights prosecutions may be moved from state to federal courts only in limited circumstances. The decision, 5 to 4, involved 29 Mississippi defendants in Le Flore County facing state charges. Justice Stewart rejected an absolute right to removal for civil rights or related offenses, while Justice Douglas dissented. A companion ruling held that if race-based equal accommodations are charged, prosecutions must proceed in either court, guiding a related Atlanta case.
