Suit Filed To Halt Work On HSPCO's Cooling Pond

The Justice Department seeks a permanent injunction to stop Houston Lighting and Power Co from continuing with a 2600 acre cooling pond at Cedar Bayou Generating Station in West Chambers County. The suit alleges construction began before a required Section 401 permit and that two navigable streams lie within the project. It notes HL&P applied to the Galveston District Army Corps of Engineers on Aug 5 1971 and that full construction resumed after a Nov 1 1971 letter from the HL&P chairman. The plant would operate six units by 1978 and could pull 3.5 million gallons daily from Upper Galveston Bay into Trinity Bay, a plan EPA says would pollute the bay and harms local wildlife.
