Appeal Not Allowed By Justice Powers In Maine Case
The probate appeal of Alfred S. Metcalf of Chelsea Massachusetts from the will of Hon Edward W Larrabee was not allowed by Justice Herbert T Powers in Sagadahoc Superior court Thursday morning. Metcalf a nephew filed a probate appeal claiming he was not legally notified when the will was probated Justice Powers ruled the petition failed to allege injury in probate and therefore could not overturn Judge Walter S Glidden s probate decree. Attorney John P Carey Jr representing Metcalf said they would pursue probate appeal procedures and may file a new appeal in October alleging lack of notification. Edward W Bridgham appeared for the Larrabee estate.
