Hay of Washington arrived first followed by Kitchin of North Carolina who was not expected due to lack of state funding. Marshall of Indiana sent word he would not attend for the same reason.

Thomas H Corcoran a sheep herder was found dead in his wagon in Marmarth North Dakota with a bullet wound in one shoulder and about 300 dollars missing from his pockets.
