Daniel Rules Tax Proposal Would Be Void
Austin Attorney General Price Daniel ruled that parts of House Bill 107 by Williams and Holt attempting a 30 cent county tax levy would be unconstitutional and void. The opinion says dedicated revenue to soil conservation would not stand under the amendment limiting purposes to flood control and rural road construction, unless essential to flood control. Provisions allowing county to city transfers and city bond issuance are not authorized and would require enabling legislation. The self executing amendment stops further state ad valorem taxes after 1950, with the rest needing legislative approval.
