Appeal Court Rules No Recount for Past Service in Railways Fund

The Appeal Court, led by Mr Justice Williams, held that the Government Railways Superannuation Fund Act of 1902 counts only continuous service. A retiring contributor who resumes service would not gain an additional allowance for noncontributing periods because the initial refund of contributions shows no extra rights. The 1908 Act was unnecessary to interpret the 1902 Act. The plaintiff retains rights from his time in service up to 1899 and nothing beyond that period.
