Savanna May 4 Judge Speer of the Federal District Court for the Southern District of Georgia ruled under the new national bankruptcy law that the United States Court has no jurisdiction over a bankrupts homestead. The homestead belongs to State Courts and cannot be treated as an asset of the bankrupt. the trustee must act outside the US Court. The decision, likely to trigger many bankruptcies, held the trustee must set aside the homestead despite waiver notes, and questions remain whether creditors can later pursue the State Courts to claim against the homestead after discharge.
