Supreme Court guides tape evidence and suspended terms
Indiana Supreme Court issued five rules for admitting sound recordings as evidence, including intelligibility and authenticity, in cases reversing lower court decisions. It also ruled that suspended sentences cannot be revoked without a new offense conviction, ordering a new trial in the Ralph James Lamar case and freeing Frank Gash from the penal farm pending review. Justice Prentice wrote the majority. Chief Justice Arterburn dissented on the Lamar retrial.
