Judge Denies Elderly Couple Divorce Request
In South Bend Indiana Superior Court Judge F Kenneth Dempsey refused to dissolve the marriage of Henry Phillips and his wife in Mishawaka after hearing their testimonies. Mrs Phillips described repeated acts by her husband including staying out overnight and longer. Phillips cited neglect and aggressive behavior such as emptying ash trays into his dresser, cutting shirt buttons, placing peppermint on his pillow, spitting in his face and choking him as reasons to leave. The judge found these acts may have justified the husband seeking separation.
