Mistrial Declared in Indiana Rape Case Over Shield Law

In Portland Indiana Judge Dale Hunt declared a mistrial in a rape case after ruling the Indiana Rape Victim's Shield Act unconstitutional. The case involves two men Nick Comstock and Jeffrey Florence accused of raping a 15 year old girl on March 14 in a rural area south of Portland. The defense argued the shield law prohibited questioning the victim's sexual history. A formal constitutional hearing will follow in Jay County Circuit Court, with potential appeal to the Indiana Supreme Court if the ruling stands.
