Supreme Court Asked To Give Duties Ruling
Indiana Supreme Court was asked to determine if state law defines a crime as refusal to perform duties by a township assessor. Paul E. Tegarden, ex Marion County township assessor, appeals after Marion Circuit Court denied habeas corpus. he was charged for omitting taxable real estate from the tax rolls and is free on bond. He argues no such offense exists and that the State Board of Tax Commissioners lacks authority to punish the alleged misconduct. The case stems from Tegarden’s extradition from Florida to Indiana and a pending trial in Marion Criminal Court.
