The State Revenue Board authority to set collection brackets drew criticism as an unlawful grant of power to the executive. The board, including Welsh, State Auditor Dorothy Gardner, and State Treasurer Robert F. Hughes, recently set 25 cent purchases for the first penny and starting at 75 cents for the second penny of the tax. Niblack's ruling extended to the act including raising the gross income tax for business corporations from one half to two thirds of a percent, estimated to bring in $60 million over two years, atop $187 million from the sales tax.
