Land Owner Has Right to Dreams
A local federal court denied the government's bid to cancel Patrick Dougherty's patent 18 miles from Butte. The opinion says Dougherty made true on oath stating no mineral claim and no mineral indications, but the finding notes years of mining interest and fraud, concluding the land was not known to be mineral and could have been patented under agricultural or mineral laws. The ruling preserves the homesteader's pursuit of wealth while noting Dougherty's hope for future mineral finds.
