Millions Involved In Railroad Suit In California
The attorney general arrives to prosecute a government suit under the 1866 act requiring interior department exemptions for mineral bearing lands in railroad patents. The government claims 45,726 acres on Southern Pacific’s main California line are mineral lands to revert to the public domain, with 12,000 acres already sold. Co-defendants are lessees profiting from mineral yields, including Kern Trading and Oil, a SP subsidiary. Patent No 22, dated July 10, 184, is challenged for its mineral land carveout. The complaint notes gold silver and other minerals in 45,726 acres known as mineral lands since before 1904.
