Bootlegging sentence tops for present federal term
Wallace Niles received the heaviest sentence among those convicted or pleading guilty in the current federal term, ten months in Leavenworth plus a 300 dollar fine and costs. A jury found him guilty after 15 minutes of deliberation for bootlegging on the Flathead reservation. Government witnesses detailed Niles selling whiskey on and off the reservation, with Indian agent Fred C. Morgan among the principal witnesses. Judge Bourquin pressed for harsher penalties to deter liquor peddling to Indians, noting the 9 percent bootlegging share on reservations and annual government costs. Niles waived the time for sentence, and defense argued for leniency, but the court imposed the term and fine.
