State primary law mandate bid to settle emergency act validity
Former Associate Justice H C Smith of Helena said he will seek a writ of mandate from the Montana supreme court to decide if emergency legislative actions are valid. He aims to determine if referendum petitions may halt administration of primary and presidential primary laws. Smith argues the assembly alone can judge emergency existence, and seeks a speedy ruling to avoid delaying next spring elections.
