Retrial Requested for Amarillo Toy Pistol Bandit
A motion for a new trial was filed by Dan McGrath, former assistant county attorney, in the case of John Loseivaky, 19, the so called toy pistol bandit who pleaded guilty to forcing Dr. O Hess to drive into a dark alley and robbing him. Loseivaky received five years in the penitentiary with the minimum sentence recommended due to his lack of counsel. McGrath argues sympathy and questions the gravity of the plea, noting the judge and jury had limited options under Texas law. A ruling date by Judge Henry S Bishop is not yet known.
