Joan Powe, 26, was freed by Brooklyn Supreme Court Justice Michael Kern after pleading guilty to a reduced manslaughter charge in the suffocation death of her 4 year old son Anthony. The case hinged on an alleged confession made before counsel was advised, a right established by a recent Supreme Court ruling. The DA said the only evidence was her account of beating and smothering the child, who died of internal injuries.
