Court lifts injunction on race based admissions in Texas

A federal appeals court in New Orleans reversed Judge Spark’s injunction blocking race based admissions at Texas public universities and sent the case back for further hearings. The Sth U.S. Circuit panel held Bakke supports limited use of race to remedy past discrimination and criticized the district court for lacking explicit factual findings. The ruling preserves a path for affirmative action arguments under Supreme Court precedent while noting Texas could consider top ten percent admissions.

Supreme Court broadens libel liability in Texas rulings

The Texas Supreme Court expands libel criteria by allowing a broadcaster to incur damages for reputational impressions created by a true story. Journalist Wayne Dolcefino of KTRK TV escapes damages for Turner's false-impression costs, while the ruling reinforces press scrutiny of public officials amid election controversy. The decision aligns Texas with most states on imputing defamation from impressions. Separately, Texas Tech University’s Vietnam Center received Adm. Elmo Zumwalt’s personal archive, including material on Agent Orange, with curator James Reckner noting the collection’s national profile impact and Zumwalt’s naval leadership in the Vietnam era.
