Supreme Court rules foreign Texas business permits bind suits
In an elaborate opinion Associate Justice Dibrell holds that a foreign corporation with a Texas permit cannot prosecute suits in Texas courts and any such proceeding should be dismissed. The Fort Worth Glass and Sand Co versus Smythe Co from Tarrant County framed the case. The law denies the right to sue in Texas when no state permit exists, but does not void contracts between the corporations. A separate Third Court of Civil Appeals decision allows a private citizen to challenge private corporation acts alleged to violate the Constitution and requires a railroad to extend into a county seat when track proximity permits, as in Felton vs Kansas City Mexico Orient Railway Co from Tom Green County. The court remanded and clarified duties under Section 9 Article 10 constitutional provisions.
