Ruling Limits Holdover Authority for School Directors
Judge McFie rules that vacancies on the Taos county school board arise from expiration of terms or official appointment and not from mandamus. The suit by Seward and Berry against Superintendent of Taos County Edwin Seward, Elledge, and others was dismissed in favor of the superintendent, with the teacher as real party in interest. Malpractice aside, no holdover power exists without re election or qualification.
