Haywood rejects all Orchard evidence claiming no knowledge of alleged plots before the trial. The defense argues the defendant was unaware of schemes and disavows involvement amid ongoing court proceedings.
Idaho July 12 Dominick Flynn a defense witness in the Haywood trial was recalled for impeachment questions. Haywood testified Orchard visited his house several times and denied plans to kill. He said Pettibone wanted to trade a federation horse for a gray mare and discussed Cripple Creek relief distribution. Haywood denied conspiring with Orchard on killings and described past contacts with Steve Adams and a 1905 Orchard letter. He asserted he knew nothing of the alleged assassinations and explained Simpkins sent a $100 draft for forwarding to Spokane. Testimony touched on Miners Magazine views and governor Steunenberg, with questions about union cards and Cripple Creek notices.
The cross examination in Denver touched on union card requirements for workers and the influence of capitalists. Haywood defended his comments about Governor Grant’s palace, described court and supreme court references, and asserted willingness to answer all questions.
