Attorneys for former Carolina Investors chairman John Sterling seek to throw out the 2003 securities fraud indictment citing a conflict of interest involving attorney Bill Bannister who previously represented Sterling and testified witnesses. Judge Johnson planned to rule by October 1 as Sterling faces trial with six former executives already convicted or pleading guilty in the HomeGold failure that defrauded about 8,000 investors of roughly 275 million dollars.

In Fulton County Atlanta a man with tuberculosis was jailed after refusing to wear a mask and take medications. Stephen Shane Driver and health officials clashed over care since 2003. He skipped clinic visits, missed doses, and hid from workers. He was admitted to St Joseph's Hospital last month but discharged for noncompliance. He will receive at least six months treatment in a Columbus facility before transfer.
