Westinghouse tax gross ups disputed in DOE transition case
The government seeks return of about $10 million plus interest from 1990 91 after Westinghouse took over management of the nuclear reservation from Du Pont. Testimony shows hundreds of transfers and new hires received relocation and tax reimbursement allowances. DOE regulations reportedly excluded gross ups for taxes, but a typographical error in the personnel appendix left out the phrase income tax. Attorneys for both sides debated contract language versus regulations with Poirer urging focus on the missing words and Wise's role.
