Court State had no right to seize polygamist sect children
A Texas appeals court ruled authorities overstepped in sending more than 440 children from a splinter group’s compound to foster homes. The Third Court of Appeals found no immediate danger justified seizure, giving a lower court 10 days to release the youths, with possible state appeal to the Texas Supreme Court. The ruling, praised by lawyers for the parents, marks a major setback for Child Protective Services in the high profile custody dispute involving the Fundamentalist Church of Jesus Christ of Latter Day Saints.
