Judge Tosses Large Part Of ESM Negligence Suit In Florida
Federal Judge Jose Gonzalez dismissed much of Thomas Tew’s civil negligence claim against the Miami firm Arky Freed and Partners and also dismissed claims against Eugene Stearns. The order found no duty for Arky to disclose knowledge of ESM’s $180 million losses learned in a Jan 21 1985 private meeting. ESM failed two months later in a major securities collapse. Arky Freed resigned from representation shortly after the meeting. a later letter to the accounting firm did not mention the losses flagged by Ewton’s lawyers.
