U.S. District Judge Richard Gergel threw out Jose Padilla’s lawsuit alleging constitutional rights violations during his detention as an enemy combatant. The judge cited potential international spectacle and qualified immunity for government and brig officials including Gates and Rumsfeld. Padilla was detained from 2002 to 2006 at a brig near Charleston after arrest at O’Hare for alleged plans to deploy a dirty bomb. He was later convicted in 2007 with two others for supporting Islamic extremist groups and is appealing his 17-year sentence.
