Wise's attorney calls appeal notice a legal formality
An attorney for Hastings Arthur Wise, sentenced to die for the 1997 R E Phelan Co. murders in Aiken, said the notice appealing to the state Supreme Court is a formality. Dudek noted the high court implied it would review when it temporarily stayed the execution and ordered a competency hearing. He said Wise claimed he did not know at trial he could plead guilty and avoid a jury, a potentially meritorious issue.
