Judge refuses to recommend appeal of murder charge
YORK Pa The judge handling the prosecution of nine white men in the 1969 shooting death of a black woman has refused to recommend a higher court review of his decision not to dismiss the murder charge against former York Mayor Charlie Robertson. Robertson’s lawyers sought the recommendation before appealing and the judge said his stance was explained in the original decision. Prosecutors expect trial and note past rulings allowing the case to proceed. Allen, 27, of Aiken South Carolina was killed by a white mob during York race riots on Newberry Street. No trial date has been set.
