Standard Oil of Indiana appeals rehearing denial
Chicago Sept 10 counsel for the Standard Oil Company of Indiana in the answer filed today to the petition of government attorneys for a rehearing of the appeal from Judge Landis judgment fining the company 29240000 for anti rebate law violations uphold the decision of Judges Grosscup Baker and Sea man of the United States circuit court of appeals reversing the judgment and lifting the burden of the enormous fine as good law. The real point is did the trial court base its fine on the wealth of the New Jersey company and its ability to pay rather than the Indiana company. The answer contends the government extracts from Judge Landis are insufficient and quotes the opinion showing New Jersey is the real defendant. The government’s suggestion to certify the question to the Supreme Court is improper there is no division of opinion among the reviewing judges. Harvey Garrison was appointed to succeed his murdered father and sworn to catch Hunter.
