Court Upholds Primary Law For Statewide Candidacy
The court rules secretary of state acted rightly in certifying O. W. Holcomb as superior judge candidate and denying Zent. White and Pendergast petition candidates are rejected as the old petition law was repealed by the primary law. Coon’s second choice voting is deemed untenable as forcing a voter to back a nonchoice. Legislature can limit party choice to candidates with at least 40 percent of the vote and allow a second phase after the primary.
