Judge Joiner of Skagit County Superior Court rules appointive county fruit inspectors and related local officers may be unconstitutional, as the constitution requires elective offices. The decision questions salary grants to county fruit inspectors and could impact wardens road supervisors and other minor posts statewide. The attorney general’s office and agricultural commissioner are urged to seek further court guidance.
The Superior Court last week returned verdicts in several cases. Bergers Union Mill Co. won 1 for a broken leg. J B Kesterson vs W F Wale awarded plaintiff the claimed amount with interest. Sidney Moor Heath and Joseph Bernard settled claims by continuance. West & Slade Co. vs Aberdeen Brick Co. foreclosures. default judgments for plaintiffs. J A Hutcheson verdict for $5 in a dispute over a larger claim. prior suit involved attorney fees and alleged agreed settlement.
Charles Hallberg and three other crew members of the tug Daring filed a libel in federal court seeking damages of 8 000 for saving the Tug Traveler from a wreck during a February 19 1905 storm. The libel states the tug was driven onto a dangerous sand bar after the towline broke and propeller and rudder were damaged. The Traveler owned by N W Lumber Co is in Aberdeen while the Daring is American owned. Deputy Marshal Davisson served the attachment at Hoquiam. Other vessels at port include schooners Henry Wilson Robert Lewers Gardiner City K J West and steamer Santa Monica with cargoes for San Francisco and San Pedro.
Leaves Aberdeen at 6 p.m. Saturdays from Foot G street dock and Portland at 3 p.m. Mondays from Foot Oak street dock with calls at Hoquiam Westport and Astoria en route. Connects at Portland with rail and steamers for all points south and east. Dock phone 213 residence 761.
