Supreme Court Reverses Chehalis Case in Clemmons Foreclosure
The supreme court overturns the lower ruling in Puget Sound Iron & Steel Works v. C. H. Clemmons and Maggie Clemmons. It orders foreclosure on the remaining balance of the purchase price minus a credit for a $500 drum replacement, and disallows most other damages. The decision sets three warranty rules: parol evidence may prove a warranty when only an order exists. replacing defective parts without timely replacement constitutes a breach. and replacing defective parts alone does not cover downtime damages.
