Property dispute over logs and land encroachment

The case centers on two claims linked to a road and a felling dispute. Maxwell Kirkpatrick Crockett admits part of a £22 10d claim. the other claim for £11 1s 8d concerns fines and damages over road access between claimant’s land and defendant’s estate. Evidence describes logs on the road and prior land use with neighbors, including testimony about Blackroak and nearby locations.

Claimant fails to prove road as public boundary

The board hears evidence about a claimed use of a road as a boundary between holdings. Witnesses cannot name others who used the road and the chairman finds no solid proof the fence line marks an accepted boundary. Amending Acts defined public roads, but the case centers on whether the strip of land fits the Act and whether the claimant showed use of the road by others. The board adjourns to decide, ultimately awarding modest sums against the defendant.
