Treason Trial Juror and Witness List Delivery Debate
A legal battle over whether under the Anne and William III acts the copy of the indictment the jury list and the witness list must be delivered to the accused at the same time ten days before trial or arraignment. Sir F Pollock argues for strict simultaneous service, while the attorney general contends the law allows slight timing variations to protect the defendant’s rights. The discussion traverses English Scottish parallels and cites Barnewall and Adolphus, Foster on Criminal Law, and Peel's Act, highlighting the impact on Frost’s case and broader justice administration.
