Newcastle Appeal Prohibits Further Proceeding in Child Maintenance Case
In chambers on Thursday Mr Justice Owen heard Alfred Charieg Moodle of Newcastle appeal against a magistrate order issued for Ellen Grant of Meriwether. The order demanded weekly maintenance for a child and payment of 12 coats by Moodle, enforceable by levy and distress or fourteen days imprisonment on default. The appeal argued the magistrate lacked power to award distress or imprisonment and that the order infringed the Desperate Wives and Children Act. Also contested was the social authority to compel payment or imprisonment and whether the order could extend to coats and other penalties. Earlier, the court found the maintenance valid, noting the payments covered by the order were for a six-month period. At St Peters Council, Alderman Campbell reported a garbage disposal conference and the proposed cost of a four-cylinder destructor at about 2000 pounds, with St Peters seen as a potential site for the installation.
