FINE MAN AND WIFE.Assault and Battery Casa In Justice Marvin’s Cmm-Flfe Counter Charges.The cases against “Shine Reed and Jerry Niles were taken up yesterday afternoon ih Judge Marvin’s court, a change Of venue having been granted from the police court. The first case to be taken up was against Mr. and Mrs. Reed, charging them with assault and battery upon Mr. and Mrs. Niles, and in this each was fined $8, Which they paid. The cases have caused considerable excitement among the friends of the two couples and the court room was crowded, the taking of testimony taking up the greater part of the afternoon, and not until this morning was the case against Mr. and Mrs. Niles gone over. Reed preferred charges of cruelty to animals against Mr. and Mrs. Niles, but on this charge the case was dismissed. The general opinion of the people and officers who attended the case was thatNilesand his wife were greatly favored and had the defendants been given the oppurtunity to secure another witness they would have won the case.Niles and hlfl Wife were accused o having given croton oil to several puppies owned by the Reeds, with the result that they all died, the bodies having been oilered as evidence iu court. Niles denied having any knowledge of croton oil and testified that he did not know of having ever seen or used any of the fluid. The attorney for tyfe defendant asked that they be allowed to secure the foreman of the round house, where Niles is employed, as a witness to prove that Niles uses croton oil every day in his duties around the shop and that he was thoroughly acquainted with the uses of the article. This the court would not allow and even went so far as to state that the evidence would not have had any weight in the case had the testimony been given.It is believed that Reed will not let the matter rest as it is, but will have papers issued against Niles and his wife in another court.
