Law Making Power The High Court on Provincial Rights in Canada
The Privy Council ruling centers on the jurisdiction of the Supreme Court of Canada under the British North America Act. The lord chancellor says internal self government spans the whole country and disputes over powers are inherent. The Ontario case sought to limit the courts reach, but the appeal was dismissed while the discussion framed the constitutional balance between Dominion and provincial authority. The piece ends with a classroom anecdote about a child naming a luxury, the South Pole.
