m9 The absence of one of the principal government witnesses, who is in Maine, yesterday caused the continuance until Wednesday of the case of Patrick Toohy, charged before United States Commis sioner Fiske with opening a letter and embezzling its contents. Toohy, one time a prosperous custom shoemaker at Harvard square, is accused of having taken a check addressed to his brother, Morris P. Toohy, and having it cashed. It is likely that the court will be asked to have Toohy’s mental condition in quired to before final action.
