M. of the first Monday next after the expiration of forty-two days from the date of the issuance of this citation, same being the 21 day of June A. D. 10948, then and there to answer defendants’ answer and cross-complaint filed in said Court, the 7th day of May A. BD. 1948, in this cause, numbered 8856 on the docket of said court, and styled J. E. Whiteside et al Plaintiffs, vs. A. M. Goss et al Defendants. A brief statement of the nature of said answer and cross-complaint is as follows: Plaintiffs are J. BE. Whiteside and R. N. Beakley. That they, together with the plaintiffs and the cross defendants named in said cross-action, are the owners of all of the oil, gas and other minerals in and under the following described land situated in Comanche County,Texas, Iown: 160 acres more or less, the A. 8. Foard Pre-emption Survey: 80 acres more or less, the J. W. Harvey Pre-emption Survey No.84; 272 acres more or less out of NW corner of Burvey No. 00, DD A Lands; 211 acres more or less, the SW 1/4 of Section No. 60, D D A lands; 80 acres more or less out of NE 1/4 of Section No. 60, D 1 A Lands; 211 acres more or less, the SE 1/4 of Section No. 60, D 1 A lands; 244 acres more or less out of the West part of Section 59, D D A Lands; 160 acres more or less out of SW corner of Section 59, D D A Lands; 160 acres more or less being the BW 1y4 of Section No. 46, D DA Lands, which lands are more particularly described in a deed bearing date of October 20, 1943, from First National Bank of Coleman, Texas, to R. N. Beakley and J. E. Whiteside, of record in Vol. 222, page 419, Deed Records of Comanche County, Texas. The defendants allege various ef and ras leases as clouds upon the title, and that by reason of such clouds and the interests of the numerous defendants, and then un known residences, and the claims asserted against such property, it is impossible for the owners of such mineral interest to obtain development and operation of such lands. Those defendants in their cross-action pray that a served be appointed and authorized to esecute oil, gas and mineral leases upon anead any portion of the land above descrmed and that Rodeo OM and Gas Company **4 Humble O11 and Gas Company be required to make a detailed statement unde seth of the oil and gas marketed from «etd lands, that clouds be removed from a title, that the interests of the various owners be partitioned in kind, or by sales under orders of the court that the variows 11 and gas leases held or claimed by the serious parties above named be declared to — cancelled and of no ef fect, and for general relief, as is more fully shown by sale answer and cross-complain on file in this suit.
