Shu- _ maker’s oflice at Rushville, filed some days ago by State Fire Mar-1 sbal Buckley charging Dennison withf arson, claiming he burned his store ‘ building and contents at Rushville, | which occurred August 9, 1912,} causing a loss of several thousand dollars.By permission of the Constable, Dennison was permitted to notify his attorney. Senator J. S. Sites, of his predicament and Attorney Sites accompanied the officer and his client lo the office of Squire Shumaker with a view to fixing up the preliminaries to a hearing and, having Mr. Dennison released on bond so he could return home with ills counsel, but when the accused entered a piea of not guilty the Justice absolutely refused to fix a bond and ordered that be be delivered to the custody of Sheriff George E. Smelters, to await the action of the court.Attorney Sites offered to go on his client's bond, whatever it might be,iSqutre.The prisoner was taken in charge by Constable Johnson who held him at his home instead of locking him up in the village^ prison and awaited the arrival of the sheriff.The sheriff left by automobile for Rushville sllbrtly after 11 o'clock to bring in the prisoner, but after floun dering about in the deep snow drifts and heavy roads the machine was unable to get through and Sherllf Smetters was compelled to return without his prisoner, arriving hotnc at two o'clock this morning.Attorney Sites returned to Lancaster and acting upon the instruction of Mr. Dennison, Attorneys M. A Daugherty and Brooks E. Snell were retained *,o assist Attorney Sites, and habeas corpus proceeoings were filed in Common Pleas Court al 10 o’clock last night claiming Mr Dennison was being illegally restrain cd of his liberty at Rushville by reason of Justice Shumaker not lix-ing a bon d. Upon a hearing of the petition Judge J. G.
