Frego; and all the spouses, heirs, devisees, lega tees, transferees, personal repre sentatives of the foregoing named defendants, and all of the unknown owners or claimants of any right, title or interest in or to Blocks 22 and 23, respectively, and Blocks 26 and 27, respectively in Dahly Fannon’s Addition to the village of Freeport, Iowa, according to Plat filet for record March 26, 1856, in office of Recorder of Winneshick County, Iowa, in Book “A,” on page 248, Defendants. ‘ To the Above Defendants: You and each of you are hereby noti fied that on or before August 9th, 1917, there will be on file in the office of the Clerk of the District. Court of Iowa, in and for Winneshiek County, the peti tion in equity of the plaintiff claiming therein that it is the absolute owner in fee simple of Blocks 22, 23, 26 and 27, in Dahly Fannon's addition to Free port, Towa, according to recorded plat thereof filed in office of Recorder of Winneshiek County, Towa, on March 26, 1856. That the plaintiff and those by, through and under whom it claims have owned, and held possession, under color of title and claim of right, the real estate herein above described, for more than ten years last past, that a certain mortgage given by Darwin and wife, covering lots 2, 3, and 4, of Block 27, Dahly Fannon’s Addition to De corah, Towa, and recorded in office of Recorder of Winneshick County, Towa, in Book “A,” on page 118, is paid off and should be cancelled of record; that a certain m given by Sally Ann Curtis to Almiron Graves covering lots 1, 2, 3 and 4, Block 27, Dahly Fannon’s Addition to Freeport, Towa, recorded in Book B, on page 3, has been paid off i should be cancelled of record; that a certain mortgage given by Wm. M. Fannon and Lucy Fannon to Thomas W. Frego, ouate lots 3 and 4 of Block 22, Freeport, Iowa, Dahly Fannon's Addition thereto, recorded in said Re corder’s office in Book A, page No. 32, has been paid off, and should be cancelled of record; that a certain Treasurer's Deed executed by the Treasurer of Win neshiek County, Iowa, to E. M. Farns worth, then Administrator of estate of Alexander Kirkland, deceased, was issued to him upon a tax sale certificate which had been held by Alexander Kirkland in his lifetime; that the said Treasurer's deed was issued to, and taken by said F. M. Farnsworth for the use and benefit of the heirs of said Alexander Kirkland, but the deed was written to E. M. Farns worth, Administrator; that said Farns worth took the deed in trust for the use and benefit of the said heirs. Said petition also prays that the estate of plaintiff in said premises be established against the adverse claims of defend ants; that title to said premises be qui eted in plaintiff; that any person wrong fully defending in this action be decreed to pay the costs; that all claimants ad verse to plaintiffs interest in and to said lands be barred and forever es topped from having further interests therein. You are further notified that unless on appear thereto and defend on or aus noon of the second day of the next term of the said court which will commence on the 17th day of September, A. D. 1917, at the Court House in De corah, Town, default will be entered, and judgment and decree rendered thereon in accordance with the prayer of the said petition, as ROICE HOOK, Attorneys for Plaintiff.
