R.12579) carries sn item reading as;foltows*t; That within, x ninety days after thtfap-«lt;i proval. df this Act a complete roll of theunallotted members of the La Pointe orBad River Band of Chippewa Indians, ofi the State of Wisconsin, entitled to ullott-nrents under, existing laws on the Bad River Reservation* shall be made and completed by the Secretary - of the Interior with the assistance of a committee of members of said band duly appointed by a general council of the Bad River Band of Chippewa Indians called for that purpose. Immediately thereafter allottments of land (Exclusive of the merchantable timber thereon). within said reservation shall be made in conformity with the provisions of the treaty of September thirteenth) eighteen hundred and fifty-four (Tenth Statutes at Large, page eleven hundred nine) and subsequent Acts of Congress relating thereto, to allpersons so enrolled who may be alive at the• • • 0time of the approval of this Act, Patentsfor allottments made hereunder, subject to the provisions herein relating to the sale of timber and the distribution per .capita of the proceeds therefrom, .shall i^s.tp the respective allottees without. d^Iay,. and such patents shall contain a clausfe Reserving to the United, States the right to cut and market merchantable timber bp.the lands so alfotted; the proceeds to be di^ppsed of as herein provided. .When the merchantable timber has been .cut from thfc lands so allotted, the title to such timber as remains pn said lands shall .thereupon pass to the respective allottees: Provided, Thatthe clause relating to the cutting and mark*-eting of merchantable timbef shall be omitted .from all patents issued for allottmentsfrom which the merchantable timber has been cut and removed at the date, of suchpatent: Provided further, Thatany land deposed hereunder shall be subject to all the laws of the United States prohibiting the introduction of intoxicants into the Indian country until otherwise provided by Congress..That the Secretary of the interior be and he hereby is authorized to sell the merchantable timber on all lands allotted, under the provisions. of this act within the Bad River Reservation, in the State o’f Wisconsin* under such rules and regulations as he may prescribe; tne net prbceeds derived therefrom) together with any undistributed proceeds derived from the sale of timber heretofore cut and sold frotu such lands, shall be distributed per capita and,.paid to the members of the band enrolled under the provisions of this Act, wheae such fhembers are or may hereafter be adjudged bv the Secretary of the Interior competent; and in cases where members hVnot been adjudged competent by the Secr’etpty o* the Interior their shares shall be deposited to their individual credit as individual Indian moneys ate new deposited Jtnd paid to them, or used for their benefit under the supervision of the Secretary of the Interior.: Provided, That before approving any contract covering the sale of timber on anyof said lands the Secretary of the Interior shall, refer the said Contract oi* -contracts to the Indian's of the Bad River Band entitledto allottments hereunder, for an expressionof their views as to the price, terms, and conditions df sale, in which matter the interests of minors shall be represented bytheir parents or natural guardians: Pro-videdf That of the amount now' on hand derived froiri the sale of tribal timber, at ieast $500;000 shall be distributed among such allottees enrolled under the provisions Bf this Act where the same are competent, or, where the allottees are incompetent, deposited to their individual credit as individual Indian moneys are now deposited, withinsixty davs from the date of the approval of the roll by the Secretary of the Interior asherein provided: Prayided further,That in the event a fair and adequate priceis not offered for the merchantable timber* * % * * on the Bad River Reserva'loh authorized tobe sold under the provisions of this Act,the Sdcretarv of the Iuterior mav in his dis-m —cretion cause to be built, equipped, andoperated a suitable saw mill or saw miLs, with appurtenances and necessary buildings, on the Bad River Reservation, fpr the purpose of manufacturing said, merchantable timber into lumber; and he is hereby authorized to use so much of the proceeds from the timber heretofore sold, exclusive of the $500,000 herein authorized to be disposed of, to erect said saw mii) or saw mills, said. v • fmill or mills to be constructed, operated; and maintained under such rules, regulations, and conditions a3 the Secretary of theInterior may prescribe: Provided,That no saw mill shall be constructed at a• % .
