Mortgage dispute ends with duress finding in Ontario case
Justice Munro presided over a Canadian foreclosure case in which Hyatt H. Dobbie and his mother claimed a township pledged not to prosecute if the mortgage was paid. The judge found no such agreement or coercion, noting the mortgage was read to Mrs. Dobbie and she signed knowingly. Value placed on the farm was $4000, not $6000, and redemption was unlikely. The decision leaves open possible appeal at Osgoode Hall.
