In the Holborn parish of St Andrew the rector seeks to establish customary tithes on houses outside London. Mr Purday, a dissenter and occupant of one such house, had resisted payment since 1838. A magistrate earlier ordered £1 due, but Purday challenged jurisdiction. The rector filed suit to recover dues and confirm rights, Purday arguing conscientious objection and irrelevance of the suit.
